From the perspective of a lawyer practicing in Estate Administration, various topics will be addressed, including: how the change to GREs impacts charities, what charities need to know with respect to estate administration and legacy giving, discussion with respect to the Principle Residence Exemption and how this impacts an estate, and the proposed changes to the capital gains inclusion rates in the 2017 Federal Budget. This broad overview will assist those involved in charitable giving and what they need to know throughout the estate administration process.

At 12 Noon on Aptil 11, the CAGP Alberta South AGM will take place at Fort Calgary. We hope that you will join us for our AGM, and for Emma Hamilton's presentation, Charity Law Update: Impact of GREs and the 2017 Federal Budget on the Charitable Sector.

Synopsis:

After the Federal Government changed the laws surrounding testamentary and inter vivos trusts, where only graduated rate estates (GREs) as of January 2016 could avoid being taxed at the highest marginal rates for up to three years, there was significant discussion with respect to how this will impact legacy giving to charities, for both the donor and the charities themselves. From the perspective of a lawyer practicing in Estate Administration, various topics will be addressed, including: how the change to GREs impacts charities, what charities need to know with respect to estate administration and legacy giving, discussion with respect to the Principle Residence Exemption and how this impacts an estate, and the proposed changes to the  capital gains inclusion rates in the 2017 Federal Budget. Presenter bio(s):

unnamed.pngEmma Hamilton is an Associate in the Wills & Estates and Family Law Groups. Her practice includes wills, estate and succession planning, wealth transfer and incapacity planning, applications for grants of probate and administration, special court applications, and living trust administration matters. In addition, she provides advice on family law matters, particularly drafting and advising on cohabitation, prenuptial and marital agreements. Emma has also recently become involved in the Society of Estate and Trust Practitioners (STEP-UK).

While attending the University of Calgary Faculty of Law, Emma spent a semester abroad at the University of Lucerne in Switzerland. Before joining McLeod Law LLP, Emma summered at the United Nations Office on Drugs and Crime in Bangkok, Thailand and was a legal research assistant for the University of Calgary.

Emma enjoys practicing yoga and barre, travelling, and exploring Calgary’s vibrant food scene.
