Giving Through a Power of Attorney

With the general population ageing, it’s increasingly important that charitably minded clients provide the person to whom they give Power of Attorney (POA) the ability to makes gifts if/when they become mentally incapacitated. This webinar will focus primarily on the necessary procedures which must be in place to facilitate charitable giving through an Attorney. For example, what types of charitable gifts can an Attorney make to a charity. What limitations does an Attorney face? What should a charity require of a POA before accepting a gift? What kind of questions could a charity face (for example, from the CRA) about a gift through a POA? As time permits, we will also look at the broad issue of individual “capacity” relative to giving through a POA.
